Fresh Bar seeking payment for repairs to dropped drinking cooler

NEW ORLEANS – A New Orleans company claims that a cooler was broken and never repaired.

Fresh Bar LLC filed a lawsuit May 19 against CCMSI Holdings Inc. and The Coca-Cola Co. in Orleans Parish Civil District Court alleging breach of contract.

According to the complaint, the plaintiff contacted the defendant to deliver a drinking cooler in July and August 2016. The suit states that upon delivering the item, the defendants dropped it and caused significant damage to it. The defendants allegedly agreed to pay to repair the item but have not done so.

The defendant is accused of breach of contract and carelessness in the delivery of the item.

The plaintiff seeks all reasonable damages, court costs, attorney fees and all appropriate relief. The plaintiff is represented by attorney Sarah M. Kalis of Scott, Vicknair, Hair & Checki LLC in New Orleans.

The case has been assigned to Division M Judge Paulette R. Irons.
