New Orleans woman claims uneven surface caused fall at Fresh Market

GRETNA – A New Orleans woman claims that she tripped, fell and was injured at The Fresh Market.

Barbara August filed a suit June 6 against The Fresh Market Inc. and ABC Insurance Co. in the 24th Judicial District Court alleging negligence.

According to the claim, the plaintiff was at The Fresh Market at 3338 St. Charles Ave., New Orleans on Aug. 11, 2015, when the incident occurred. The suit states that the plaintiff tripped and fell on an uneven surface that should have been marked or fixed.

The defendant is accused of negligence by failing to take the necessary precautions and lack of maintenance.

The plaintiff is seeking all reasonable sums due, attorney fees and court costs. The plaintiff is represented by Earl Marcelle III of Marcelle & Associates in Baton Rouge.

The case has been assigned to Division E Judge John Molaison Jr.
