New Orleans Bulk Terminal accused of damaging shipment

NEW ORLEANS – A company claims that a shipment was damaged.

The Mosaic Co., A Crop Nutrition Co., Mosaic Global Sales LLC and Starr Indemnity & Liability Co. filed a lawsuit June 14 against New Orleans Bulk Terminal LLC in Orleans Parish Civil District Court alleging breach of contract.

According to the complaint, a delivery was being made by a rail car of Biofos from New Orleans to Houston. The Biofos was owned by Mosaic. When the shipment arrived in New Orleans, it was in a good state, but during the transfer of the cargo, it was allegedly damaged and dirtied on the conveyor belt.

The defendant is accused of breach of contract for failing to protect the shipment, failing to exercise proper care and overall negligence.

The plaintiff seeks all reasonable damages, court costs, attorney fees and all appropriate relief. The plaintiff is represented by attorney C. Gordon Starling Jr. of The Law Office of Gordon Starling LLC in New Orleans.

The case has been assigned to Division G Judge Robin M. Giarrusso.
