Orleans Parish driver claims other motorist failed to yield, resulting in crash

NEW ORLEANS – An Orleans Parish man claims his car was struck by a negligent driver.

Justyn Hawkins filed a lawsuit June 21 against Falcon Insurance Co.; David Resendiz, also known as David Cardenas; and USAA General Indemnity Co. in Orleans Parish Civil District Court alleging negligence.

According to the complaint, the plaintiff driving on Burbank Drive, near Paris Avenue in Orleans Parish, when the incident occurred. The suit states that the defendant failed to yield while trying to cross Paris Avenue and collided with the plaintiff's car.

The defendant is accused of negligence by failing to take the proper care, failing to see what should have been seen and overall negligence.

The plaintiff seeks all reasonable damages, court costs, attorney fees and all appropriate relief. The plaintiff is represented by attorney Craig A. Gentry of Morris Bart LLC in New Orleans.

The case has been assigned to Division A Judge Tiffany G. Chase.
