NEW ORLEANS – A woman claims her mother was denied basic health care and hygienic care while at a New Orleans care center.

Edna McManus individually and on behalf of her deceased mother, Shirley Riley, filed a lawsuit June 21 against Commcare Corp., doing business as Greenbriar Community Care Center, and ABC Insurance Co. in Orleans Parish Civil District Court alleging negligence.

According to the complaint, the plaintiff is seeking damages for an incident that took place in August 2004. The suit states that the plaintiff's mother did not receive adequate health care and suffered from the center's failure to provide her with clean linens and bathe her to prevent infection. The suit also claims the center failed to provide her with the necessary medication.

The defendant is accused of negligence and breach of the standard of care.

The plaintiff seeks all reasonable damages, court costs, attorney fees and all appropriate relief. The plaintiff is represented by attorney J. Michael Daly Jr. in Metairie.

The case has been assigned to Division G Judge Robin M. Giarrusso.
