Several people claim they were injured by gunfire during altercation at Discount Zone

NEW ORLEANS – A group is seeking damages, claiming that they were caught in the cross-fire of a gunfight and injured.

David Fairley, Darleen Fairley, Louis Pierre and Yvonne Pierre filed a lawsuit against Kerry Francois, Adnan Alrashed, Hajer Adnan LLC and XYZ Insurance Co. in Orleans Parish Civil District Court, alleging negligence.

According to the complaint, the plaintiff is seeking damages for an incident which took place on Dec. 12, 2016, at Discount Zone, 6711 Chef Menteur Highway. The suit states that Renarda Gibson, Francois' girlfriend, became involved in a fight with Alrashed, the owner and manager of the store. Alrashed pulled out a 12-gauge Mossberg shotgun and threatened Gibson. Francois, who was in the car at the time, saw the altercation and went inside. After Alrashed allegedly pointed the gun at Gibson and Francois and their child, Francois returned to the car to retrieve a 9mm handgun, according to the complaint. 

David Fairley and Yvonne Pierre were in the store when Francois fired his gun from the parking lot, striking Alrashed, David Fairley and Yvonne Pierre. 

Francois, Alrashed and Discount Zone are accused of gross negligence, negligent use of a firearm, incitement to violence and overall negligence.

The plaintiff seeks all reasonable damages, court costs, attorney fees and all appropriate relief. The plaintiff is represented by attorney Scott L. Sternberg and Michael S. Finkelstein of Sternberg, Naccari & White LLC in New Orleans.

The case has been assigned to Division D Judge Nakisha Ervin-Knott.
