Woman claims she tripped on rug at Gerber Collision

NEW ORLEANS – A woman claims that she was caused to trip and fall on a rug at a local business.

Irma I. Melancon filed a lawsuit on Nov. 15 against Universal Underwriters Insurance Company, American Zurich Insurance Company, and Champ's Holding Company LLC, doing business as Gerber Collision & Glass, in Orleans Parish Civil District Court alleging negligence.

According to the complaint, the plaintiff is seeking damages for an incident that allegedly took place on Feb. 16, 2017 at Gerber Collision & Glass, 4047 S. Carrolton Ave. in New Orleans. The suit states that the plaintiff tripped and fell on a rug that had been left at the entrance.

The defendant is accused of negligence through failing to see that the rug was not in a good position and overall negligence of management.

The plaintiff seeks all reasonable damages, court costs, attorney fees and all appropriate relief. The plaintiff is represented by attorney J. Bart Kelly III of Alvendia, Kelly & Demarest LLC in New Orleans.

The case has been assigned to Division G Judge Robin M. Giarrusso.
