Entergy accused of negligence over sidewalk hole

NEW ORLEANS – A bicyclist claims that an energy company left a hole in the sidewalk, which caused him injury.

Earl Barthe Jr. filed a lawsuit on Nov. 7 against Entergy Energy Company LLC, Cimarron Builders LLC and Zurich in Orleans Parish Civil District Court alleging negligence.

According to the complaint, the plaintiff is seeking damages for an incident that  took place on Nov. 7, 2017. The suit states that the plaintiff was riding his bike on Gen. DeGaulle Drive when he hit a hole in the sidewalk, which caused him to be thrown from his bike. The plaintiff claims that the incident was the fault of the defendants who failed to take the necessary precautions to prevent individuals from being injured following work in an area.

The defendants are accused of negligence.

The plaintiff seeks all reasonable damages, court costs, attorney fees and all appropriate relief. The plaintiff is represented by attorney Marcus O. DeLarge of DeLarge Law LLC in New Orleans.

The case has been assigned to Division J Judge Cherrell S. Taplin.
