Lawsuit filed in death of child in hotel pool

NEW ORLEANS – Two individuals are seeking damages for the wrongful death of a child.

Keviyonna Austin, individually and on behalf of her minor children, and Tammy L. Roberts, individually and on behalf of her deceased son, filed a lawsuit Jan. 4 against Marvin Dodd and M&S Hospitality LLC, et. al. in Orleans Parish Civil District Court alleging negligence and wrongful death.

According to the complaint, the plaintiff is seeking damages for an incident that took place July 8, 2017. The suit states that the defendant rented a hotel room to the plaintiffs. The plaintiffs' children were swimming in the pool when the plaintiff's child drowned. The plaintiff claims that the child drowned due to negligence of the defendant to guard the pool or provide proper supervision.

The defendant is accused of negligence and wrongful death damages.

The plaintiff seeks all reasonable damages, court costs, attorney fees and all appropriate relief. The plaintiff is represented by attorneys Suzette P. Bagneris of The Bagneris Firm LLC in New Orleans.

The case has been assigned to Division I Judge Piper Griffin.

The Orleans Parish Civil District Court Case No. is 2018-78.
