Property owner seeks damages from city for unauthorized repairs

NEW ORLEANS – A property owner claims they were forced to have unauthorized repairs on their property.

Super Awas LLC filed a lawsuit Jan. 9 against the City of New Orleans and Peleus Insurance Co. in Orleans Parish Civil District Court alleging breach of contract and fraudulent activity.

According to the complaint, the plaintiff is seeking damages for an incident that took place Jan. 19, 2016. The suit states the plaintiff's roof collapsed and that the City of New Orleans demolished the roof without warning to the plaintiff. The defendant is then said to have demanded payment by the plaintiff even though they were never in agreement to having the city make the changes which it did. In addition to the damages that the defendant caused to the house, the demolition of the roof also caused the plaintiff to lose rental income from the property, which had been leased out prior to the collapse.

The defendant is accused of breach of contract and fraudulent activity.

The plaintiff seeks all reasonable damages, court costs, attorney fees and all appropriate relief. The plaintiff is represented by attorney Regel L Bisso of Bisso & Miller LLC in Metairie.

The case has been assigned to Division N Judge Ethel S. Julien.

The Orleans Parish Civil District Court Case No. is 2018-223.
