Majority property owner trying to collect fees from minority owner's heirs

NEW ORLEANS – A man is seeking damages claiming that a deceased minority percentage property shareholder has failed to pay his portion of fees and his unknown heirs now must pay. 

Clyde Patton filed a lawsuit on Jan. 22 against The Unopened Succession of Roy L. Dearie in Orleans Parish Civil District Court alleging failure to reimburse.

According to the complaint, the plaintiff is seeking damages, claiming that he is the owner of 67 percent of the property located at 1006 Milan St. in New Orleans. The suit states that Dearie's heirs, who are not known, have failed to pay his portion of the property taxes for the period of time from 2012 to 2018 as well as taxes to maintain the property.

The defendant is accused of failure to reimburse.

The plaintiff seeks all reasonable damages, court costs, attorney fees and all appropriate relief. The plaintiff is represented by attorney Jonah Freedman of Jonah Freedman Law LLC in New Orleans.

The case has been assigned to Division I Judge Piper D. Griffin.
