Man says neighbors have refused requests to partition land

NEW ORLEANS – A property owner claims his neighbors have been unwilling to partition a piece of property.

Robert Smith filed a lawsuit Jan. 18 against Chauna Modica, Deborah Modica and Roxanne Modica in Orleans Parish Civil District Court alleging unwillingness to partition.

According to the complaint, the plaintiff is seeking damages, claiming that the defendants who are co-owners of the property located at 3030 Barrone St, New Orleans, have failed to agree to partition the property despite requests from the plaintiff.

The defendant is accused of failure to partition.

The plaintiff seeks all reasonable damages, court costs, attorney fees and all appropriate relief. The plaintiff is represented by attorney Tony Dooley of The Dooley Law Office LLC in New Orleans.

The case has been assigned to Division M Judge Paulette R. Irons.

The Orleans Parish Civil District Court Case No. is 18-413.
