Midfirst Bank sues for more than $141,000 on unpaid mortgage

GRETNA – A bank is seeking more than $141,000.

Midfirst Bank filed a complaint on Nov. 12 in the 24th Judicial District Court against Manual B. Diaz, individually and as heir to the succession of Elizabeth Rodrigue Diaz, Dana Olavarrieta Galvez, Nicole Olavarrieta Hugger, and Simone Olavarrieta O'Connor as heirs to the succession of Elizabeth Rodrigue Diaz

According to the complaint, the plaintiff is seeking damages for an unpaid balance on a mortgage. The suit states the defendant has failed to keep up with payments on a property. The plaintiff has made amicable demands but to no avail. The defendant still remains negligent in the sums due of $141,447.08 plus an interest of 4.5 percent per year until paid.

The defendant is accused of sums due on a mortgage.

The plaintiff is seeking all reasonable sums due, attorney fees and court costs. The plaintiff is represented by J. Donald Morgan of Kizer, Hood and Morgan LLP in Baton Rouge.

The case has been assigned to Division O Judge Danyelle Taylor.
