Woman seeks damages following fall in a Sam's Club store

GRETNA – A woman is seeking damages alleging that she tripped and fell on a pallet jack in Sam's Club.

Lynette Theodore filed a complaint on Dec. 19 in the 24th Judicial District Court against Sam's East Inc., dba Sam's Club, Walmart, et al.

According to the complaint, the plaintiff is seeking damages for an incident that took place on Dec. 20, 2017, when the plaintiff was a customer at the defendant's property at 1527 Manhattan Blvd. The suit states the plaintiff was caused to trip and fall over a pallet jack that had been left in a dangerous position and that patrons were not warned of. The plaintiff alleges she was caused to sustain injuries to her body due to the negligence of the defendant.

The defendant is accused of negligence and failure to keep a lookout to prevent injury.

The plaintiff is seeking all reasonable sums due, attorney fees and court costs. The plaintiff is represented by Benny Council of The Council Law Firm LLC in New Orleans.

The case has been assigned to Division M Judge Henry Sullivan Jr.
