Plaintiff claims New Orleans Modular Homes has failed to repay loan

GRETNA – A man is seeking damages after he says he was not repaid for a loan that he made to a home builder.

Craig Borges filed a complaint on Jan. 30 in the 24th Judicial District Court against New Orleans Modular Homes LLC and John Albert Rodriguez.

According to the complaint, the plaintiff is seeking damages for an incident that took place after the plaintiff and defendant entered into an oral agreement. The plaintiff says he provided funding to the defendant for the construction and sale of four modular homes. The suit states the defendants has failed to pay off the balance loaned to them, despite amicable demand as the defendant has breached contract.

The defendant is accused of breach of contract.

The plaintiff is seeking all reasonable sums due, attorney fees and court costs. The plaintiff is represented by J. Geoffrey Ormsby of Smith & Fawer LLC in New Orleans.

The case has been assigned to Division P Judge Lee Faulkner Jr.
