Fired Audubon Communities employee claims he was terminated for reporting mold in the workplace

GRETNA – A man is suing his former employer, alleging a mold situation in his former workplace was not remedied and he was terminated unfairly.

Byron Morgan filed a complaint on March 26 in the 24th Judicial District Court against Baton Rouge Community Investor LLC and ACM LLC, dba Audubon Communities.

According to the complaint, the plaintiff is seeking damages for an incident that began on October 26, 2018, when the plaintiff noticed mold on his clothing resulting from exposure in his workplace. The plaintiff requested that the defendant send out an inspector. The defendant is alleged to have said that someone would come out and resolve the issue, but this never happened. The plaintiff continued to ask for a solution. As a result, the plaintiff alleges he was terminated after the property was repeatedly not cleaned and the plaintiff kept pushing for a resolution.

The defendant is accused of negligence and unfair termination.

The plaintiff is seeking all reasonable sums due, attorney fees and court costs. The plaintiff is represented by Galen Hair of Scott, Vicknair, Hair & Checki LLC in New Orleans.

The case has been assigned to Division N Judge Stephen Enright Jr.
