Grocery store operator sues tax collector for alleged fraud

GRETNA – A man is suing a tax collector, alleging that he was made to believe that he owed more money than he did.

Walter H. Maples Inc., dba Sureway Supermarket, filed a complaint on April 3 in the 24th Judicial District Court against Joseph P. Lopinto III, in his capacity as the Sheriff and Ex Officio Tax Collector. According to the complaint, the plaintiff is seeking damages for an incident that took place beginning on April 6, 2018 when the plaintiff received a notice of delinquent tax-formal assessment from the defendant listing that the plaintiff was indebted to the defendant for $117,349.29. 

The plaintiff alleges that the penalties were improperly assessed as the items purchased were tax exempt. The defendant is accused of fraud.


The plaintiff is seeking all reasonable sums due, attorney fees and court costs. The plaintiff is represented by Robert T. Garrity Jr in Harahan.

The case has been assigned to Division L Judge Donald A. Rowan Jr.
