Supplier of fuel and barging services Orion Holdings sues cargo ship for failure to pay

NEW ORLEANS – Orion Holdings Limited is suing an ocean-going cargo ship for more than $190,000 in unpaid fuel and barging services.

Orion Holdings, Limited filed the lawsuit in the U.S. District Court for the Eastern District of Louisiana against M/V Sincere.

According to court documents, the M/V Sincere is an ocean-going cargo ship. Orion Holdings is a supplier of fuel oil to ships and other vessels. The lawsuit states that on June 27, 2023, at the request of authorized representatives of the M/V Sincere, the plaintiff supplied the M/V Sincere with Very Low Sulphur Fuel Oil along with associated barging services at the Port of Kandala in India. The plaintiff claims to have issued an invoice for a total amount of $203,121.17 for the fuel and services on July 1, 2023.

Orion Holdings claims that as of the date of the complaint, the defendant has only made partial payments, leaving an outstanding balance of $191,941.10. The plaintiff alleges that the nonpayment constitutes a breach of the terms under which the fuel and services were provided.

Orion Holdings seeks judgment in the amount of the outstanding balance, interest, and any other liquidated damages plus attorneys fees and any other relief the court deems proper. Additionally, the plaintiff is requesting that a process in rem be issued against the vessel, her engines, boilers, tackle, furniture, apparel, appurtenances, etc. placing the vessel under the custody of the Marshals of the District to be sold to satisfy the claim. Additionally, the plaintiff requests indemnification for the arrest or attachment of the vessel and any other relief deemed just and proper by the court.
