A Florida company has filed a federal lawsuit accusing bed and breakfast of unauthorized use of a photograph.
Prepared Food Photos Inc., formerly known as Adlife Marketing & Communications, filed its complaint against Annadele Inc. doing business as Annadele's Plantation. The plaintiff, a Florida-based corporation specializing in licensing professional photographs for the food industry, claims the defendant, a Louisiana-based corporation operating a bed and breakfast with a New Orleans style restaurant, unlawfully used one of their copyrighted images.
The image in question is a photograph of cooked lobster tails titled "LobsterTail002", created by a professional photographer employed or contracted by the plaintiff in 1998. The photograph was registered with the Register of Copyrights on October 31, 2016. The plaintiff alleges that on August 24, 2021, the defendant displayed and published the work on its website and social media platforms without proper licensing.
