A Louisiana resident has filed a lawsuit against a major automobile manufacturer, alleging that the company sold him a defective vehicle and failed to honor its warranty obligations. On March 14, 2025, Tommy Hoke filed a complaint in the United States District Court for the Eastern District of Louisiana against General Motors, LLC.
According to the complaint, Hoke purchased a new 2022 Chevrolet Silverado 1500 from Best Chevrolet in Kenner, Louisiana on December 26, 2022. The vehicle came with both implied and express warranties guaranteeing its merchantability and fitness for ordinary use. However, Hoke claims that soon after purchase, the vehicle exhibited significant defects including persistent water leaks and power loss issues. Despite multiple repair attempts by authorized dealers over several months—spanning nearly 120 days without his vehicle—the problems persisted. "No reasonable consumer would purchase a vehicle in Louisiana where rainfall is frequent if these problems were known before sale," states the complaint.
Hoke's lawsuit accuses General Motors of violating both Louisiana Redhibition Laws and the federal Magnuson-Moss Warranty Act. Under these laws, he argues that GM breached both implied and express warranties by failing to deliver a defect-free product or adequately repair it despite numerous opportunities. The plaintiff contends that these hidden defects existed at the time of sale but were not discoverable until after delivery. As such, he seeks rescission of the sales contract along with reimbursement for all related costs including financing charges and insurance premiums.
The plaintiff is seeking substantial relief from the court: rescission of the sale; return of the purchase price including collateral costs; compensation for economic losses; attorney fees; and additional damages exceeding $100,000 as allowed under applicable laws. He also requests cancellation of any remaining debt on the vehicle.
