Claiming unskilled employees caused him to sustain injuries, Sunnie Listern Johnson filed suit against his employer Omega Protein Inc. on April 14 in federal court in New Orleans.
According to the complaint, Johnson was injured on April 20, 2010 during his employment as a seaman aboard the F/V Willard P. Leboeuf.
He states he suffered possible ruptured or herniated disks as well as other injuries while he was assisting the crew in making a set.
The defendant is accused of negligence for failing to provide a safe place in which to work, failing to warn about the oily substances on the deck, failing to clean or remedy the hazardous condition, failing to discover and correct unsafe conditions, creating and maintaining an unseaworthy vessel, retaining unskilled and careless employees, breach of legally imposed duties and failing to provide prompt medical care.
The plaintiff is seeking damages for medical expenses, physical pain and mental anguish, disability, punitive damages, maintenance and cure, attorney's fees, interest and court costs.
Johnson is represented by Lawrence Blake Jones and Kristi A. Post of Scheuermann & Jones in New Orleans.
U.S. District Judge Carl J. Barbier is assigned to the case.
