NEW ORLEANS – A New Orleans woman is suing a pharmacy for injuries she claims to have received n their premises.
Judith Ibarz filed suit in the Orleans Parish Civil District Court against Rite Aid, Headquarters, Rachel Investors and their insurers on May 17.
Ibarz claims she was a customer of the Rite Aid located at 4936 Metairie Blvd. in Metairie when she tripped and fell over the step up from the parking lot to the sidewalk. The plaintiff alleges she has serious and debilitating injuries due to the fall.
The defendants are accused of owning a defective one step riser, failing to warn of a hazard, failing to inspect the araea, failing to correct defects, not providing a safe walkway, creating a hazard, creating an unreasonable risk, failing to maintain and correct the defect and allowing the plaintiff to walk on the defective step up.
An unspecified amount in damages is sought for medical expenses, pain and suffering, aggravation, disabilities, loss of wages, loss of earning capacity and loss of consortium.

The case has been assigned to Division F Judge Christopher J. Bruno.
