GRETNA – A Massachusetts-based demolitions contractor is suing a Louisiana-based contractor over fees related to the transport of demolished materials to be used in a hurricane protection project.
NASDI, LLC filed suit against Bertucci Contracting Company, LLC in the 24th Judicial District Court on Oct. 10.
According to the complaint, NASDI was awarded a contract to demolish the old Twin Spans bridge connecting New Orleans to St. Tammany Parish after the structure was damaged in Hurricane Katrina. The plaintiff claims that as part of that contract Bertucci removed sections of the bridge and off-loaded them to a staging site for use by Bertucci in a hurricane project at Lake Borgne. NASDI asserts that it was not paid fees by the defendant for handling and transporting the old materials from the bridge. The plaintiff claims that it never received payment from Bertucci despite providing invoices for the work over several months and that after it submitted a demand letter Bertucci responded by terminating the contract.
The defendant is accused of breach of contract for non-payment for subcontracted work, breach of state statute and wrongful termination of contract.
Damages in the amount of $915,773.73 are sought by NASDI.
