NEW ORLEANS – A New Orleans business owner is suing its property insurance agency for not paying for damage caused by a taxi that crashed into its building.
400 Burgundy Street LLC filed suit against Certain Underwriters at Lloyd's of London, subscribing to Certificate No. LP11-148 in the Orleans Parish Central District Court on May 1.
The plaintiff alleges that on May 4, 2012 taxi cab driver Albert Combre Jr. drove into its building resulting in damage to the entryway as well as severe structural damage. 400 Burgundy Street asserts that it contacted a claims adjuster who sent out an inspector two weeks later, but after 30 days the business still had not receive an insurance settlement. The plaintiff claims it requested the inspection report completed by the inspector, but never received anything and thus had to retain its own experts to assess damage to the structure.
The defendant is accused of breach of contract.
The plaintiff is seeking an unspecified amount for all property damages to the building, payment for code upgrades necessitated by the virtue of the building being located in a historic preservation district, statutory penalties of 50% of the damages owed, general damages and reasonable attorney’s fees.
400 Burgundy Street LLC is represented by Jonathan P. Lemann of New Orleans-based Couhig Partners LLC.
The case has been assigned to Division F Judge Christopher J. Bruno.
