Deckhand sues for injury allegedly caused by tripping over pipe on job site

NEW ORLEANS – A Chalmette man is suing a port operator and a shipping company after he allegedly was injured in an on the job accident.

David M. Morici filed suit against Ports America Louisiana Inc. and Cooper/T. Smith Corporation in the Orleans Parish Central District Court on July 16.

On October 8 2012, while working on a floating crane barge, Morici attempted to exit the crane when he tripped over a pipe. While falling, the plaintiff claims he jerked his right arm behind his back and claims to have injured his right shoulder and lower back due to the fall.

The defendant is accused of failing to honor plaintiff’s request for maintenance and proper maintenance of the property.

An unspecified amount in damages is sought for impairment of earning capacity and lost future income, medical expenses, past present and future, physical pain and suffering, mental pain and suffering and loss of enjoyment of life.

Morici represented by attorney Richard H. Barker of New Orleans.

The case has been assigned to division I Judge Piper D. Griffin.
