GRETNA – A man who claims he was violently beaten assaulted by three other men in the restroom of a Jefferson Parish restaurant early one morning is suing the restaurant and others for his injuries.
Juan Soto filed suit against Rony Javier Jimenez, an unknown security guard, Jennys Restaurant LLC and their insurer in the 24th Judicial District Court on July 2.
Soto claims that he was a patron at Jennys Restaurant at 4 a.m. on May 4 when he entered the restroom and three men including Jimenez blocked him from exiting and then violently assaulted him. The plaintiff alleges that he received serious injuries in the assault including a broken leg and lacerations to his forehead and arm. Soto asserts that the unknown security guard and an unidentified individual removed him from the restroom and did not call the police or an ambulance.
The defendant is accused of assault, battery, false imprisonment, failing to render aid, failing to protect person and property, failing to develop and maintain a security plan, failing to properly secure the premises, failing to properly train employees and failing to provide an environment safe from assault and battery.
An unspecified amount in damages is sought for bodily injuries, emotional distress, humiliation and embarrassment.
Soto is represented by Edwin M. Shorty of New Orleans-based Edwin M. Shorty & Associates.
The case has been assigned to Division H Judge Glenn B. Ansardi.
