GRETNA – A company that is accused of being responsible for damages for its part in a pipeline project that allegedly polluted two oyster beds is suing its insurer for not covering the damages stemming from that case.
Project Consulting Services Inc. filed suit against Steadfast Insurance Company in the 24th Judicial District Court on Aug. 22.
Project Consulting Services Inc. claims it had two insurance policies through Steadfast Insurance Company when it was part of the Denberry Green Pipeline project that was constructed in Galveston Bay off the Texas coast. When those with interests in the Denberry Green Pipeline were sued by Galveston area oyster companies Oysters R Us and Jurisie & Sons Inc. for pollution that allegedly damaged the oyster beds, the plaintiff alleges the defendant should have been liable for covering expenses of the lawsuit and its outcome. Project Consulting Services Inc. asserts Steadfast Insurance Company denied its claim, stating that it did not meet the standards of the contract.
The defendant is accused of bad faith insurance practices and breach of contract.
An unspecified amount in damages is sought for declaratory judgment and attorney’s fees and expenses.
Project Consulting Services Inc. is represented by Sarah E. Stogner of New Orleans-based Carver, Darden, Koretzky, Tessier, Finn, Blossman & Areaux LLC.
The case has been assigned to Division H Judge Glenn B. Ansardi.
