NEW ORLEANS – A property holding company is suing over a company's alleged failure to fill out a mortgage payoff request form.
J.H.G.G. Holdings LLC filed suit against Touro Street Inc. in Orleans Parish Civil District Court on Sept. 12.
On July 3 J.H.G.G and Touro signed a contract relating to the sale of properties located at 2751, 2753, 2754 and 2801 St. Ann St. in New Orleans. The titles to these properties were clouded with various mortgages and liens, the suit claims. In addition, a 60-day corrective period was called in the contract to resolve any title grievances.
During this corrective period, the defendant was solicited to complete a mortgage payoff request form. The director for Touro, Bruce Cerniglia, spoke with Grant Guthrie, member of J.H.G.G., during a meeting regarding not having ever entered into a contract between the two companies. After repeated inquiries from countless representatives of J.H.G.G., Cerniglia finally acknowledged the existence of a contract, however, he still hesitated on completing the mortgage payoff request form, the suit claims.
Touro’s alleged failure to execute the form constitutes a breach of contract with J.H.G.G, the suit claims.
