NEW ORLEANS – A construction company is being sued by a subcontractor for more than $32,000 due to an alleged open account violation.
C.H Fenstermaker & Associates filed suit against Gulf South Operators Inc. in the Orleans Parish Civil District Court on Sept. 15.
C.H. Fenstermaker claims that between the months of September 2012 and February 2014, the petitioner performed specialized services for Gulf South. In addition, the plaintiff contends invoices attest to the exact scale of work completed. The total amount in question the plaintiff is seeking from the defendant is approximately $32,994.80.
The petitioner further claims that on July 18, 2014, a written demand was forwarded to the defendant via certified mail requesting the aforementioned sum be paid in full. On July 23, 2014, Gulf South received the demand request, as evidenced by the return receipt presented by C.H. Fenstermaker. However, despite numerous inquiries, the defendant has allegedly failed to pay the aforesaid expenses entirely.
Thus, C.H. Fenstermaker states the alleged failure of compensation through work performed unto Gulf South constitutes an open account violation.
The plaintiff is represented by Emile Joseph Jr. and Robert A. Robertson of Allen & Gooch.
The case has been assigned to Div. N Judge Ethel S. Julien.
