GRETNA – Winn Dixie is being sued by a man who alleges he suffered injuries a result of tripping over a carpet and falling at the store's entrance and subsequently when a store employee attempted to help him.
Keith St. Germaine filed suit against Winn Dixie in the 24th Judicial District Court on March 30.
According to lawsuit, St. Germaine was walking in the entry of of the Winn Dixie located at 2112 Belle Chasse Highway in Gretna when he tripped over a “bunched up” carpet and fell to the floor. After the incident, St. Germaine claims a Winn Dixie employee attempted to help him, but also fell, causing further injuries to him.
The plaintiff allege that all injuries he suffered on that day were caused by the defective condition of the entry way. St. Germaine also argues that the employee who tried to help him was not properly trained in the assistance of an injured customer, which caused the additional injuries he suffered.
The defendant is accused of various negligent acts and knowing of the defect that caused the plaintiff's injuries.
An unspecified amount in damages is sought for mental anguish, emotional distress, pain and suffering, permanent physical disability, medical expenses, loss of enjoyment of life, lost wages and loss of wage earning capacity.
