NEW ORLEANS – A subcontractor is suing a contractor claiming he was never paid for siding work on a construction project.
Troy Leger filed suit against David Oliver, doing business as Phase 1 Construction of New Orleans and Brian Loval and Joann Loval individually in the Orleans Parish Civil District Court on June 1, 2015.
Leger claims he never received payment for contracted services rendered on a home owned by Brian and Joann Loval.
The plaintiff alleges that he was contracted to do siding work for Oliver on behalf of Brian and Joann Loval. Although Leger claims that an initial payment was supposed to have been made at the start of the job, this allegedly never occurred. Furthermore, an initial payment still allegedly had not been received at a point when the work was 90 percent complete.
Leger contends that Oliver has received some payment from the Lovals for his work and that despite repeated amicable demands, the defendant has not paid the balance due on his account.
The defendant is accused of contractor fraud.
An unspecified amount in damages is sought for the $4,097.25 initially agreed upon in the contract as well as all attorney and court filing fees accumulated in the pursuit of this debt.
