NEW ORLEANS – A man is seeking damages claiming that he was sold a defective Volkswagen vehicle under false pretenses.
Kameel S. Abbasi filed a suit against Volkswagen Group of America Inc., Volkswagen Aktiengesellschaft and Moffitt Volkswagen Inc. in the Orleans Parish Civil District Court on June 1.
According to the claim, the plaintiff purchased a 2014 Jetta Sportswagen in June 2015. The suit states that this model and other models of Volkswagen vehicles included defective features and were marketed in a fraudulent manner. The suit additionally states that the car purchased by the plaintiff possessed a 2014 defective TDI, though it was sold to the plaintiff under the premises of it being a high performance, low emissions and high fuel efficiency vehicle. Following the purchase of the vehicle, the plaintiff allegedly began to experience problems and became aware of the defects, causing him to seek a rescission of the sale.
The defendant is accused of violation of the Louisiana Unfair Practices Act and deceptive actions in relation to this case.
The plaintiff is seeking an unspecified amount in damages. He is represented by Eric R. Nowak and Shirin E. Harrell of Harrell & Nowak in New Orleans. The case has been assigned to Division M Judge Paulette R. Irons.
