GRETNA – A nurse is seeking damages after she was allegedly terminated due to false drug screening results.
Cynthia Peterson filed a suit against Global Safety Network Inc., Global Medical Review, Jon Bradbury, Alere Toxicology Services Inc. and Venita Henderson in the 24th Judicial District Court on July 6.
According to the claim, the plaintiff was employed by Ochsner Hospital when on July 7, 2015, there was a discrepancy in a pill count in her department, which was later determined to be an error. The plaintiff was allegedly made to take a urine sample for drug and alcohol testing. The suit states that though the plaintiff insisted that she had not consumed any alcohol, the test stated that there was alcohol in her system. The incident resulted in the plaintiff's termination, the suit says, though it was later revealed that the results had been affected by the plaintiff's diabetes.
The defendants are accused of negligence in relation to the Louisiana Medical Malpractice Act, failing to adequately train the laboratory staff, failing to meet the applicable standard of care and overall negligence in the treatment of the situation.
The plaintiff is seeking an unspecified amount in damages. She is represented by Joseph M. Bruno and Melissa DeBarbieris of Bruno & Bruno LLP in New Orleans. The case has been assigned to Division C Judge June Berry Darrensburg.
