Man claims that his attorney failed to defend him

NEW ORLEANS – A man is seeking damages, claiming that an attorney he hired failed to properly defend him.

Richard Perniciaro filed a suit against Smith & Fawer LLC and Michael S. Fawer in the Orleans Parish Civil District Court on Aug. 11.

According to the claim, the plaintiff hired the defendant to defend him and the plaintiff provided the defendant with payment for the service. The suit states that the defendant failed to run a conflict check and soon discovered that there was a conflict that would prevent the defendant from continuing to provide services to the plaintiff. Furthermore, the defendant allegedly failed to properly defend the plaintiff, and failed to return the money that he had been paid.

The defendant is accused of breach of contract through the actions taken.

The plaintiff is seeking an unspecified amount in damages. He is represented by William J. Larzelere III.

The case has been assigned to Division B Judge Regina Bartholomew Woods.
