NEW ORLEANS - Sharon Lavigne Perrilloux, on behalf of her minor child A.P., filed a complaint on July 8 in Tangipahoa Parish District Court against Kubota Corporation, Kubota Tractor Corporation, Kubota Manufacturing of America Corporation, Kubota Industrial Equipment Corporation and Home Depot.

According to the complaint, Michael L. Perrilloux rented a Kubota U17 excavator from Home Depot. While on the excavator, the excavator allegedly rocked and threw Perrilloux from the cab, causing him to strike his head on a nearby pole. Perrilloux later died due to his injuries.

Perrilloux seeks damages, attorney's fees and cost of suit. Perrilloux is represented by M. Paul Wilkins.

The defendants recently removed the case to New Orleans federal court.
