GRETNA – The parents of a St. Bernard Parish minor are suing a Wendy's restaurant for injuries allegedly received in a fall on its premises.

Jennifer and Archie Thompkins, on behalf of their minor daughter, filed suit against Wendy's Internatinal, Inc. in the 24th Judicial District Court on Sept. 27. The Thompkins claim their daughter visited the Wendy's located at 4801 Airline Drive in Metairie and as she was walking towards the bathroom she slipped in a puddle of grease and fell to the floor. The plaintiffs allege their daughter sustained serious injuries in the fall including injuries to her head.

The defendant is accused of failing to warn of the dangerous condition, failing to properly inspect the area in question, failing to do what was necessary to keep the area free from dangerous conditions, failing to remove the puddle of grease, failing to properly supervise and instruct employees to remedy hazards and allowing a dangerous condition to exist.

An unspecified amount in damages is sought for medical expenses, pain and suffering, mental pain and anguish, disability, disfigurement, scarring, loss of enjoyment of life, past and future loss of wages and loss of earning capacity.

The case has been assigned to Division E Judge John J. Molaison, Jr.
