Man claims physical disability after glass bottle allegedly falls on him at checkout register

GRETNA – A Jefferson Parish man is suing a local retailer for alleged injuries he received when a glass bottle fell on him in the store.

Ricardo Cedillo filed suit against Wal-Mart Stores, Inc. in the 24th Judicial District Court on Oct. 8. Cedillo claims he was checking out at the Wal-Mart located at 8912 Veterans Blvd. in Metairie when the cashier knocked a glass bottle from the register and it fell on him. The plaintiff alleges that the incident resulted in personal injury and other damages.

The defendant is accused of failing to remove hazards from the area, failing to warn of the danger, failing to use reasonable care in protecting patrons, failing to properly maintain the premises, permitting a hazardous condition, failing to post warning signs, creating a hazardous condition on the premises, failing to have proper policies and procedures in place to avoid risk and failing to follow its policies and procedures to avoid risk.

Damages in an amount less than $50,000 is sought by Cedillo for mental pain and suffering, physical pain and suffering, physical disability, medical expenses and loss of enjoyment of life.

Cedillo is represented by Ivan A. Orihuela of Kenner-based Riguer Silva, LLC.

The case has been assigned to Division B Judge Cornelius E. Regan.
