Lawsuit: Physical harm by co-workers caused dialysis nurse to quit job

Federal Court
Dialysis

NEW ORLEANS -- A woman is suing her former employer after allegedly experiencing discrimination, harassment and physical harm from her co-workers.

Kimberly Triplett filed a federal complaint on June 22 in the U.S. District Court for the Eastern District of Louisiana against Fresenius Medical Care Louisiana Dialysis Group, for age discrimination, harassment and retaliation.

According to the complaint, Triplett began working at Fresenius on Nov. 1, 2019 as a dialysis nurse. In early 2020, before the pandemic, Triplett was feeling targeted and harassed while on the job.

One supervisor allegedly made the comment "I should have hired someone younger" and in a later incident after hitting Triplett said, "I just hit Kim, Kim are you hurt or bruised?”

Triplett informed a supervisor she was leaving for the day after the hitting incident and then called police, the suit says. Triplett was informed by another supervisor to return to work the next day and she said she did not feel comfortable, and asked to be transferred, but was denied her request.

In another alleged incident, Triplett says another co-worker hit her and said “I’m tired of you, I can’t stand working with you.” Triplett resigned from her position on Oct. 13, 2020.

Triplett seeks compensatory damages, attorney's fees and cost of suit. Triplett is represented by Raynique T. Keelen of Fuller Keelen Law Firm, LLC.
